If you have a contract with the company you can hold them to it. You signed for a fully functional pool with a water feature by the sound of things. I would contact them and ask them to fix all of the problems to "as new condition" if they don't do that, I would contact the ACCC and make a complaint. $40,000.00 is a lot of money, so make sure they provide the product you paid for.
